The Hong Kong Legislative Council passed the Occupational Safety and Occupational Health Legislation (Miscellaneous Amendments) Bill 2022 (the “Bill”) on 19 April 2023 to ensure better protection for workers in Hong Kong.
In summary, the key amendments in the Bill include increasing penalties for occupational safety and health (“OSH”) offences; the determination of fines by the courts by taking into account the financial information submitted by the convicted party or otherwise obtained from reliable sources by the prosecution; the categorization of summary offences and their related maximum fines to be based on the summary offence’ level of severity (“minor”, “serious” and “very serious”); and the time limit for prosecution for OSH offences to be extended from 6 months to 9 months.
