Our Managing Partner, Alan Chiu, recently had the honor of speaking at the 2024 Hong Kong Arbitration Week, shedding light on the topic of “Path and Prospect for Chinese Enterprises to utilize Investor-State Dispute Settlement (ISDS) in Dispute Resolutions”.
This seminar, co-organized by Wolters Kluwer and the Shanghai International Arbitration Centre (SHIAC), brought together esteemed lawyers, business leaders, and arbitration experts from Shanghai, Hong Kong, and beyond to delve into the intricacies of dispute resolution for Chinese enterprises venturing abroad.
During the seminar, Alan delivered an insightful keynote on “Cross Border IP-related Disputes in ISDS”. Alan highlighted the growing trend of IP-related ISDS cases, especially with the rise of emerging technologies. He shared key takeaways from notable cases like Eli Lilly v. Canada and Philip Morris v. Uruguay, demonstrating how ISDS can effectively resolve IP disputes.
Alan also participated in a panel discussion on “New Perspectives on Dispute Resolution for Chinese Enterprises Going Global”, where he emphasized the importance of understanding evidence disclosure procedures in IP litigation and the challenges faced by Chinese enterprises in this regard.
